Colorado’s refund mechanism for defendants who clear their names makes the state unique, meaning the eventual decision in an ongoing U.S. Supreme Court case will not have a wide reach beyond the state’s borders. Instead, the case’s outcome will dictate whether Colorado can continue treating money collected from acquitted defendants as state property or if they must comport with longstanding tradition in other jurisdictions to give it back automatically.
