After its recent merger with Levine Sullivan Koch & Schulz, Ballard Spahr’s media law practice has grown significantly. And although the former media boutique firm brought with it a national reputation and landmark case history, firm partners in Denver are providing expertise to local media outlets as well.
Ballard Spahr partner Steve Zansberg is currently handling cases for the Denver Post and the Colorado Independent. Both outlets filed petitions to obtain court records in two different cases.
The psychiatric reports of Aurora theater shooter James Holmes are under seal in the case file, though the information in the reports was discussed during the trial and quoted openly. The Post filed a motion for access, and the case awaits a ruling by the Arapahoe County District Court.
“I’m hopeful those records will be unsealed so there can be a more detailed discussion of the psychiatric issues involved in that case, particularly at a time where there’s an ongoing political discussion about the future of the death penalty and its application to people with mental health issue as was the case with James Holmes,” Zansberg said.
